IWRCF’s Competition team provides consulting and representation services in cases related to competition law, such as administrative proceedings and merger reviews, in addition to assisting its clients in the running of their businesses under the local and international competition laws. Such services include.

Main Services Provided:

  • Review of transactions’ structure in view of the competition law and local jurisprudence
  • Review of sensitive contractual clauses
  • Submission of transactions to the Brazilian Competition Authority (CADE), as well as coordination of multi-jurisdictional notifications
  • Representation of third parties interested in opposing to transactions under CADE’s analysis
  • Analysis of viability, negotiation and execution of leniency agreements, including the coordination of multi-jurisdictional agreements
  • Legal assistance in the submission of competition-related accusations to CADE
  • Defense of companies and individuals in administrative proceedings and/or lawsuits related to antitrust violations (such as cartels, abuse of dominance, tying, etc.), including coordination of defenses in several jurisdictions
  • Assistance and coordination of defenses in investigations or criminal proceedings related to anti-competitive conducts
  • Assistance and representation (with the assistance of the Litigation team of IWRCF) in actions of civil liability for anti- competitive conducts
  • Review, negotiation and execution of settlement agreements (Termos de Compromisso de Cessação – TCCs) in administrative proceedings pending before CADE
  • Auditing focused on antitrust matters
  • Preparation and implementation of antitrust compliance programs, training and dawn raid simulations
