The Digital Law and Data Protection practice at IWRCF has a specialized team that constantly monitors advances in the regulation on data privacy and protection and internet relations in Brazil. It provides consulting and litigation advice to clients in the most diverse issues involving the operation of applications, websites and other business tools, in order to guarantee compliance to the legislation, as well as to prevent and mitigate risks to the activity deriving from the digital law and data protection regulations.

Main Services Provided:

  • Adequacy to the General Personal Data Protection Law (Law No. 13,709/2018) comprising the mapping of activities that include processing of personal data, preparation of a diagnosis and delivery of a Data Protection Impact Assessment
  • Training aimed at executives and employees to prepare them for the adequacy and compliance with the regulations on privacy and data protection
  • Review and drafting of agreements related to privacy and transfer of personal data, and technology contracts (technology transfer, software licensing, cloud services, SLA, among others)
  • Review and drafting of Terms of Use, Privacy Policies, internal procedures and corporate policies (such as Information Security Policies)
  • Review of website content in view of the applicable legislation
  • Representation in litigation, in the civil sphere, concerning ISP liability, net neutrality, and aspects of privacy and data protection
  • Drafting of legal opinions on issues related to digital law and data protection
  • Review of internal practices and conducts involving Information Security incidents
