Brazilian Data Protection Law enters into force this Friday (9/18)
After a long period of expectation and uncertainty as to the final date of entry into force of Law No. 13,709/2018 (Brazilian General Data Protection Law – “LGPD”), the President sanctioned the Provisional Measure No. 959/2020 (“MP 959”) last Thursday, September 17, and therefore, the LGPD will enter into force on September 18, 2020.
This means that individuals and legal entities, who process personal data, must observe and respect the precepts provided for in the LGPD (considering the exceptions also provided for by law).
Nevertheless, in regard to the administrative sanctions provided for in the LGPD, it will only be applied by the National Data Protection Authority as of August 1st, 2021.
